Alhaji Abubakar Atiku, the People's Democratic Party PDP's candidate for president in the most recent election, asserted before the Presidential Election Petition Court on Friday that the Independent National Electoral Commission, INEC, lacks the legal authority to defend Ahmed Bola Tinubu from charges of drug trafficking and dual citizenship.
 

Regarding Tinubu's qualifications for the most recent presidential election, Atiku argued that INEC is a "meddlesome interloper" who has defended Tinubu.
 
 
In particular, Atiku charged that the electoral body was preoccupied and was fishing in other people's problematic waters.
 
At Friday's hearings, INEC moved a motion on notice asking the Court to throw out some of the accusations Atiku made against Tinubu in his petition through its attorney, Mr. Kemi Pinhero SAN.
 
The electoral body urged with the Court to reject 32 claims filed against Tinubu by Atiku, including forfeiture of $460,000 in the United States of America (USA), possession of Guinea's passport, and Allegiance to other governments, among other things.
 
In his suit, Atiku contested the determination that Tinubu and the All Progressives Congress, or APC, had won the February 25 presidential election jointly.
 
According to INEC, the court should dismiss the claims that made up 32 paragraphs of Atiku's appeal for a number of grounds, including lack of jurisdiction.
 
In contrast, Atiku attacked INEC's proposal in a counter argument and urged the court to reject the position taken by the electoral authority through his principal attorney, Chief Chris Uche SAN.
 
In the rebuttal affidavit, Uche stated that Tinubu, the second defendant in the petition, should not have to fight his or her corner or make a case for themselves.
 
Atiku's main attorney specifically demanded that INEC should be impartial and simply defend the way the election was conducted in question.
 
He claimed that by taking up Tinubu's case against the law, the electoral body had backfired by transforming into a busy body and intrusive invader.
 
The senior attorney said that the request made by INEC to support Tinubu was not only unjustified and unusual, but also represented a serious abuse of the legal system.
 
Uche claimed that any attempts by INEC to get foundational allegations against Tinubu should be viewed as futile, vexatious, and annoying efforts that should not be let to stand.

 
"INEC shouldn't be involved in the conflict between Tinubu and his supporters; instead, it should act impartially and, at most, stand up for the results of the election, which are the focus of Alhaji Abubakar Atiku's petition.
 

"This Tinubu support application by INEC lacks merit." It should be categorically rejected and consigned to the trash bin since it is so utterly incompetent.

 
As a result, the Senior Attorney requested that the Court dismiss INEC's motion due to its flagrant abuse of the legal system, lack of substance, and egregious incompetence.
 
The substantive petition's decision date has also been set by the court's chairman, Justice Haruna Simon Tsammani.
